Workshop on Transitional Justice

The gross incidence of violence in various forms around the world in the latter part of the 20th century has led to the flourishing of scholarly studies in the field of ‘Transitional Justice.’ It is a field that considers a wide range of questions concerning social, political and legal accountability for past violations of human rights, incidences of authoritarianism and mass inflictions of violence. The area is prominent in socio-legal studies where it is clear that in transitional contexts, much is demanded of law and its ability to perform a restorative role. The capacity of criminal trials and truth commissions to enforce accountability becomes central. The need for new and creative legal strategies in transitional contexts renews interest in a wider range of accountability mechanisms. These include reparations, memorialisation projects, constitutional reform, human rights commissions, combatant reintegration, and institutional developments that seek to reinforce the rule of law.
We are interested in papers for a workshop that focus on one or more aspects of legal strategies in the area of transitional justice, both at the national and international level. We encourage submissions that explore the intersections between law and politics in democratic transitions, and how such intersections might be relevant to the task of facilitating restorative justice. In particular, we would be pleased to receive papers that focus on private sector dimensions of transitional contexts, including compensation and reparations, accountability of private corporate interests in societies that are witnessing or have witnessed violent conflict, as well as papers that deal with the economic aspects of transitional justice in general. We would also welcome submissions that examine judicial accountability in transitions and judicialisation of politics in transitional societies.
